Participant Release, Waiver of Liability, Assumption of Risk, and Code of Conduct Addendum

Please read carefully. By signing or enrolling, you agree to all terms below. This document is a legally binding contract under the laws of the State of New York.

1. Voluntary Participation & Assumption of Risk

I acknowledge and affirm that I am voluntarily enrolling and participating in activities offered by Empire Dance Studio NYC (“Empire Dance Studio”), including but not limited to: group classes, private lessons, rehearsals, performances, social dance events, workshops, off-site events, and any activity sponsored or organized by the Studio (collectively, “Activities”). I understand that dance activities involve inherent and unavoidable risks, including but not limited to: slips, falls, dizziness, fainting, physical exertion, collisions, sprains, strains, fractures, aggravation of existing conditions, and risks occurring inside or outside the studio or when representing the studio. I voluntarily assume all risks, whether known or unknown.

2. Release of Liability & Waiver of Claims

To the fullest extent permitted by New York law, I release and hold harmless Empire Dance Studio NYC, The Mambo INC, its owners, officers, employees, instructors, contractors, agents, managers, representatives, successors, and assigns from any and all claims arising from participation, including those arising from ordinary negligence. This includes personal injury, medical events, property damage, or incidents occurring on-site or off-site.

3. Medical Authorization

In an emergency, I authorize the Studio to obtain or administer first aid or medical care. I am responsible for all medical expenses.

4. Indemnification

I agree to indemnify and defend the Released Parties against any claims or expenses arising out of my participation or conduct.

5. Membership Terms, Cancellation & Billing

• Minimum 3-month commitment for all recurring memberships.
• Members may cancel their membership at any time by submitting a written cancellation request to [email protected] at least 7 days before the next renewal date.
• Early cancellations within the minimum 3-month commitment period incur a $100 cancellation fee.
• All sales are final. No refunds. Credits may be granted at Studio discretion; they expire in 90 days.
• By completing your purchase, you acknowledge that you were informed of and had the opportunity to review this no-refund policy prior to completing your transaction. Electronic agreement or signature constitutes full acknowledgment and acceptance of all terms herein, including the no-refund policy.

6. Zero Tolerance Conduct & Harassment Policy

The Studio prohibits harassment, discrimination, bullying, or inappropriate conduct. This applies on-site and off-site. Sexual harassment includes unwanted advances, comments, touching, or any behavior of a sexual nature.

7. Reporting Process

• Report incidents immediately to management.
• Document details.
• The Studio will investigate and take appropriate action.

8. Studio Responsibilities

The Studio maintains a safe environment, enforces policies, and may remove any participant who endangers others.

9. Entire Agreement

This document is the entire agreement and is governed by New York law.

By enrolling, I confirm I understand and agree to all terms and voluntarily waive substantial legal rights, including the right to sue. I have read this document in its entirety, had the opportunity to ask questions, and sign freely and voluntarily.

Acceptance of this waiver is completed electronically through Mindbody at the time of enrollment or purchase.
